The court noted that according to two witnesses, police head constables on duty, a mob consisting of more than 100 persons appeared from the direction of Mustafabad and started pelting stones and throwing petrol bombs at shops and houses. The Gokulpuri police station had filed a chargesheet against the nine accused for rioting and other offences in Chaman Park, Shiv Vihar Tiraha Road and surrounding areas.
The court convicted Mohammad Shahnawaz, Mohammad Shoaib, Shahrukh, Rashid, Azad, Ashraf Ali, Parvez, Mohammad Faisal and Rashid under the Indian Penal Code's sections 147 (rioting), 148 (rioting, armed with a deadly weapon), 380 (theft in dwelling house), 427 (mischief causing damage of Rs 50 or upwards), 436 (mischief by fire or explosive substance with intent to destroy house, etc.), 149 (unlawful assembly guilty of offence committed in prosecution of common object) and 188 (disobedience of order promulgated by public servant). I find it well established that all the named accused persons in this case did become part of an unruly mob, which was guided by communal feelings and had the common objective of causing maximum damage to the properties of persons belonging to the Hindu community." The court will hear arguments on the sentencing on March 29, special public prosecutor D K Bhatia informed.
